Chapter 13 Debt Restructuring Plans
A chapter 13 bankruptcy is intended for individuals with any regular source of income.  We will work with you to structure a plan to repay all or a part of your debts, usually over a three year period.  During this time, the law prohibits most creditors from debt collection activities.

The main advantage of Chapter 13 plans is the chance to save a home or other important asset.  You may be able to stop foreclosure proceedings and then cure your delinquent mortgage over time.  You may be able to extend payments for other secured loans.  You will address all unsecured loans with fairness and to the extent your income allows.  If the plan is confirmed, the plan will often function like a debt consolidation loan, with a single monthly payment to the bankruptcy trustee.

A Chapter 7 bankruptcy case does not involve a plan of repayment as Chapter 13 does.  Your individual assets and liabilities are carefully listed and evaluated.  You may be able to retain ownership of many (often all) of your assets as they may be exempt from sale under bankruptcy law.  The rules as to what property is or is not exempt can be fairly complex.  The bankruptcy trustee is charged with collecting and selling all non-exempt assets and to distributing any proceeds fairly among your allowed creditors. 

Filing a case will usually invoke a powerful and automatic stay (or stop) to debt collection activities.  Bankruptcy allows you to fairly address all creditors with dignity and to be fully discharged from almost all debts in order to make a fresh start.  There are many considerations and some eligibility requirements for a Chapter 7 bankruptcy.
